Rationale for Section VI

Often times, educators must balance the need for openness and the need to respect privacy rights in determining whether to share certain information that would be considered an invasion of privacy. Educators should respect and honor students' rights to privacy by only utilizing information in the manner for which it was expressly intended. In doing so, educators maintain the confidentiality entrusted to them and avoid illegal and unwarranted disclosures of such information. Accordingly, this principle prohibits the improper use of any information submitted without acknowledgement, permission and/or using the information to further personal interests whether on the part of the educator, other authorized school personnel or by other students. Furthermore, implicit in our profession, educators have the responsibility to protect all students from harm by removal of any misleading, defamatory, inciteful or incorrect information. It is also our responsibility as a profession to have a general knowledge of federal, state and local laws that effect confidentiality, privacy and AUP's. Furthermore, such information should be afforded to students in order that they make sound, ethical decisions both within and outside of the school environment.
